General information


Berto's SPA, henceforth the company, developed this Privacy Policy in order to describe the management method of the www.bertos.com website, regarding processing the personal data of the visitors or users of the site.  The information is given pursuant to art. 13 of Legislative Decree 30 June 2003, n. 196 (Personal data processing code) - to all those who connect to the company website and use the web services from www.bertos.com. The information is only given relative to the above site and not for other websites the user may visit by clicking on the links.

BERTO’S S.P.A. has also developed the Privacy Information in order to describe how the data are processed to define and continue the contractual relations with the company’s customers and suppliers.

The Privacy Policy and Privacy Information are an integrative part of our site and the services we offer. Access to the site and its use are all allowed on the assumption this Privacy Policy and Privacy Information have been read and understood. If you do not agree with the Privacy Policy and Privacy Information, please do not use our site. The company may alter, update all or part of the Privacy Policy and Privacy Information. Any changes or updates to the Privacy Policy and Privacy Information will be available for users in the Privacy section of the site as soon as the updates are activated, and they will be binding as soon as they are published in the site. If the user does not wish to accept the changes, they can stop using the site. The continued use of our website, products and services after the changes or updates have been published means that the changes have been accepted and the binding nature of the new terms and conditions is acknowledged. The website www.bertos.com is the property of the company and entirely managed by the same.
 
Type of data that are processed and processing purpose:

Browsing data 

The IT systems and software procedures used for the site functions normally acquire certain personal data that is transmitted automatically when internet communications protocols are used. These data are not collected to be linked to identified people, but given the nature of the data they could enable identifying the users by means of processing and association with data held by other parties. This data category includes the IP addresses or domain names of the computers users use to access the site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file received in reply, the numeric code of the reply status from the server (successful, error, etc.) and other parameters of the operating system and IT environment of the user. These data are used only for anonymous statistical purposes about the site and are immediately deleted once they have been processed. The data could be used to ascertain responsibility in the case of any cybercrimes that damage the site: so barring this fact, the web contact data only exist for the time needed for the processing purpose. 

Data provided voluntarily by users and visitors


When users or visitors access the site, they send their personal data to access certain services (e.g. newsletter, "work with us", etc.), or to make requests by email, and this means the company acquires the email address or other personal data that are processed exclusively for the purposes outlined in this statement. Your data will be processed for purposes to satisfy your specific request, for contract obligations, for tax and accounting purposes, invoicing log, disputes, credit protection, satisfying current legal obligations. The Privacy Information should be referred to for greater details. 

Cookies

Apart from the browsing data, users and visitors are free to decide whether to provide their personal data or not. Failure to provide the data could entail failure to obtain what they request. Consequently, visitors can browse the site without revealing any personal data.
Once you have registered, the personal data is collected only for the services indicated in the information sheet.
Visitors to the site can provide their data:

•to take part in initiatives promoted in the website
•to buy the products marketed in the website
•to express interest in working with the company or to answer job posts
•to contact the company using the prepared form

In order to use the services, the user may be requested to provide all or some of the following data: name, surname, age, address, postcode, email address, town, country, date of birth, phone, mobile phone, fax, company name, VAT number, tax or national insurance number, payment details. Other information could also be requested. In all events the Privacy Information should be referred to for greater details. 

Newsletter Section 

In the NEWSLETTER section of the Berto's SPA website, there is a form the user should fill in to register with the newsletter, to allow us to send periodic emails of a commercial nature. Registration with the newsletter is subject to accepting the company Privacy Policy, by flagging the box and consenting to the data processing as outlined in the company Privacy Information. 

“Work with us” Section 


In this section users can express their interest in working with the company or to answer a job posting for vacant positions or new ones. If you decide to send your personal data they will be used exclusively for this purpose and processed by people assigned to the task using normal internal personnel management procedures. 

Contact Section 


By filling in the form in this section, users can send a personal message to the company to obtain a reply. The personal data are requested as outlined above, otherwise the service will not be available. It is essential to accept the company Privacy Policy, by flagging the box and consenting to the data processing as outlined in the company Privacy Information, in order to use the service. 

Data Processing Section 

Pursuant to art. 28 Legislative Decree 30 June 2003, n. 196 (Personal data processing code), the owner of the personal data acquired from the website is the company, Berto's SPA, with registered office in Tribano, Viale Spagna 12, Padua Register of Companies number 01897800288. The personal data can be processed within the limits and with the methods outlined in this statement, by company employees and assistants who are assigned to or responsible for processing, who receive appropriate operating instructions and work under the strict authority of the processing controller. The personal data are collected and processed by the company using printed and/or computer methods, in writing or on magnetic, electronic or telematic medium, and used according to principles of correctness, legality and transparency in order to protect the privacy and rights of the parties concerned.
The Managing Director, Ing. Marco Dal Pont, of BERTO’S S.P.A. is appointed as processing manager. An updated list of all the processing managers and assignees by the company can be requested from them or the processing manager at the following email address: bertos@bertos.com.
Disclosure

The personal data are communicated to Berto's SPA in order to respond to requests for information, and they may be communicated to certain authorities and institutions to satisfy legal obligations, or to the judicial authorities when requested. Furthermore, the company uses other companies and individuals for certain activities, such as sending emails, delivering parcels, making payments. Barring any legal obligations, regulations, EU laws and orders from legally authorized authorities, the personal data will not be disclosed but could be communicated to the following parties or categories:
a)company representatives
b)shipping and transport companies
c)banks and financial institutions
d)factoring companies
e)insurance companies and credit insurance companies
f)professionals appointed by the company and company consultants
g)companies providing services to the company and for sending commercial information
h)audit and certification companies
i)in order to protect our credit and to better manage our rights in all our commercial relations, the data could be learnt of by the following categories or managers: (i) credit recovery firms, (ii) companies managing databases in order to assess the credit worthiness of a company and/or to provide commercial information, (iii) financial advisors, (iv) legal advisors.
These parties only have access to the personal data that is strictly necessary for their tasks. The company emphatically forbids them from using the data for any other purpose, and obliges them to process the data according to this Privacy Policy and law. 
In the website the company does not intentionally acquire any sensitive or juridical personal data. Pursuant to art. 4 of the Privacy Law, sensitive data include the personal data that could reveal race and ethnic origin, religious and philosophical or other beliefs, political opinions, membership to political parties, trade unions, associations or organisations of a religious, philosophical, political or union nature, and personal data that could reveal health and sexual orientation. Juridical data, again pursuant to art. 4 of the Code, include personal data that could reveal any legal proceedings, as per art. 3(1) from letters a) to o) and from r) to u), of DPR n. 313 of 14 November 2002 regarding criminal records, administrative sanctions database, pending sentences, status as a detainee or under investigation as per articles 60 and 61 of the Criminal Procedure Code. It is advisable not to give this sort of data in the website. Should it be necessary (e.g. belonging to protected categories in the case of sending a CV for a job, in reply to a job posting or to express interest in working with the company), please send a registered letter to the company registered address containing your written statement that you accept this sensitive data can be processed.

Data conservation


The personal data of users and visitors to the site, including the data freely provided to receive information or other communications by filling in the forms in the site, will be conserved only for providing the requested service and for the time strictly needed to do this, and for no longer than proportionally envisaged in article 11 of the Privacy Code as strictly necessary for processing. 

Exercising your rights

Pursuant to art. 7 of the Privacy Code, you have the right at any time to obtain confirmation whether your data exists or not and learn of their content and origin, you may check the accuracy and request integrations, updates or corrections. Pursuant to the same article, you have the right to request the cancellation, transformation into anonymous form or block the data if it is processed in violation of law, and also oppose the processing if you have legally motivated reasons. These requests should be sent in writing or by contacting the processing holder at bertos@bertos.com.

Data security

The company protects personal data by applying internationally recognised security levels, and security procedures to protect personal data:
•from unauthorised access
•from improper use or disclosure
•from unauthorised changes
•from accidental or intentional loss or deletion.

Minors

The www.bertos.com site is not to be used by minors and they are not authorised to make purchases in the sites. We understand the importance of protecting information addressed to minors, especially online, and therefore we do not collect nor intentionally keep any personal data about minors.

Privacy Information 


Pursuant to art. 13 Legislative Decree n. 196 of 30 June 2003 (Personal data protection code or Privacy Code).
Legislative Decree n. 196 of 30 June 2003 “Privacy Code” as amended (henceforth the “Code”) envisages the protection of the personal data of individuals and other parties. BERTO’S S.P.A. (henceforth also the “Company”), as the processing controller, and pursuant to article 13 of the Code, informs you that, when any contract agreement is established with you, certain personal and fiscal or other data is collected about you – which may be acquired verbally, directly or through third parties – and said data is considered personal data by the Code (henceforth the “Data”).
Consequently in relation to said data, we inform you as follows: 

I) Processing purpose 


The data that are collected and processed by the company throughout the duration of the contractual agreement and afterwards as part of its normal business are processed for the following purposes: 
a)Correct and complete definition of the contractual relationship with you and to satisfy the relative contractual obligations. 
b)Satisfying administrative, accounting and fiscal obligations and which are relative to continuing the contractual agreement with you.
c)Satisfying obligations envisaged by law, regulations, EU regulations, and orders for legally authorized authorities.
d)Pursuing Company improvement and development and of its commercial relations, by means also of marketing, promotional, information campaigns (e.g. sending the newsletter), statistics, quality control, customer satisfaction assessment (either directly or through third parties or specialised companies appointed as assignees or responsible for data processing), using automatic  methods (e.g. fax, email, sms, mms, automatic call centres, etc.). 

II) Processing method 


The personal data are collected and processed by the company using printed and/or computer methods, in writing or on magnetic, electronic or telematic medium, and used according to principles of correctness, legality and transparency in order to protect the privacy and rights of the parties concerned
The data will not be disclosed but could be communicated in Italy or abroad (within the EU) to parties or categories as outlined in paragraph IV below.
The company protects personal data by applying internationally recognised security levels, and security procedures to protect personal data:

•from accidental or intentional loss or deletion.
In compliance with the provisions of the “Guidelines for promotional activities and to combat spam” dated 4 July 2013, please note that your consent for receiving promotional and marketing communications as per paragraph I)d) above, is also extended to activities performed using automated tools (e.g. fax, email, sms, mms, automated calls, newsletters, etc.) and also traditional contact methods (printed letters and/or call centre operators). 

III) Compulsory or optional nature of data and consequences in the case of refusal 

Providing your data is not compulsory, but necessary as failure to provide the data for the purposes outlined in paragraphs I)a), I)b), I)c) above would mean we would be unable to define or pursue any contract agreement with you. Providing your data for the purposes outlined in paragraph I)d) is totally optional, and needs your express consent and should you not agree, you would not be included in any market surveys, statistical analyses and surveys, and you would not receive any commercial or promotional information or offers. 

IV) Parties or categories who could receive the personal data and the communication and disclosure area. 


Barring any legal obligations, regulations, EU laws and orders from legally authorized authorities, the personal data will not be disclosed but could be communicated to the following parties or categories:
a)company representatives

V) Rights of the person concerned as per article 7 of the Code.


You may exercise your rights at any time with the processing controller, at the addresses as given below, pursuant to art. 7 Legislative Decree n. 196/2003 “Personal data access rights and other rights”, that we give the full text of below for your convenience: 

1.You have the right to obtain confirmation as to whether or not personal data concerning you exists, even if not yet recorded, and their communication in intelligible form 
2.You have the right to know:
a)The origin of personal data.
b)The purposes and methods of processing.
c)The logic applied in case of processing using electronic instruments.
d)The identity of the manager, controller and the designated representative under Article 5, paragraph 2.
e)The subjects or categories of persons to whom personal data can be communicated or who can learn about them as appointed representative in the State, any managers or agents.
3.You have the right to obtain:
a)Updating, rectification or, when interested, integration of data.
b)The cancellation, anonymization or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed.
c)Certification that the operations in letters a) and b) have been notified, also as regards their content, to those to whom the data were communicated or disclosed, except if this requirement proves impossible or involves an undertaking that is manifestly disproportionate to the protected right.
4.You have the right to oppose, all or in part:
a)For legitimate reasons the processing of personal data, even if it is pertinent for collection purposes.
b)The processing of personal data for purposes of sending advertising materials or direct selling or for carrying out market research or commercial communication

In relation to promotional and marketing activities as outlined in this information at paragraph I)d), you have the right to request termination of this processing using both automated contact methods and traditional methods. Furthermore, you also are able to exercise just part of the right, i.e. to stop sending promotional communications using just one or a number of the contact tools you have given your consent to. To exercise these rights, please contact the processing controller as indicated below.
